Orascom Development beendet Rechtsstreit mit Falcon Hotels S.A.E

Altdorf/Kairo, 23. Juni 2014 - Orascom Development Holding AG (Orascom Development) ist in 2008 mittels Tochter- und Partnergesellschaften (als Käufer) in ein Vertragsverhältnis mit Falcon Hotels S.A.E (als Verkäufer) getreten, um das Cape Citadel Projekt und Hotel zu kaufen und zu entwickeln. Diese Transaktion führte später zu mehreren Streitigkeiten zwischen Falcon und Orascom Development. Die Streitigkeiten umfassten zahlreiche Gerichtsverfahren sowie vier grössere Schiedsverfahren in zwei verschiedenen Rechtssystemen.

Erfreulicherweise konnte Orascom Development nun eine freundliche Einigung mit Falcon Hotels S.A.E zur Beilegung dieser Rechtsstreitigkeiten erreichen. Die Einigung wird sich positiv auf Orascom Developments Gewinn- und Verlustrechnung auswirken, da zuvor gebildete Rückstellungen in Höhe von USD 60 Millionen (CHF 54 Millionen) aufgelöst werden können. Basierend auf einer aktuellen Managementeinschätzung wird Orascom Development jedoch nur 80 % dieses Betrages auflösen.

Im Zuge dieser Einigung und mit sofortiger Wirkung erkennen Falcon Hotels S.A.E und seine Mehrheitsaktionäre den Rechtsanspruch von Orascom Development auf alle Cash Flows aus der Betriebstätigkeit des Cape Citadel Hotels an.

Cape Citadel ist ein 5-Sterne Hotel mit 514 Zimmern in Sahl Hasheesh südlich von Hurghada am Roten Meer. Das Hotel generierte im Geschäftsjahr 2013 einen Nettogewinn von CHF 4.2 Millionen.
